Criminal: Plea: Unauthorized use of a financial transaction device; habitual criminal
Proceedings below: Appellant entered a plea of no contest. After an enhancement hearing, she was determined to be a habitual criminal and sentenced 10 to 20 years in prison.
Issues: The district court erred in (1) denying Appellant’s 6th amendment right to counsel; (2) proceeding with sentencing on the same day as the plea hearing as there were unresolved proceedings that would affect the sentence. Appellant also alleges ineffective assistance of trial counsel for failing to file an interlocutory appeal of the denial of the entry of appearance of private counsel.
