Case Summary

S-15-0779, Natallia Davydzenkava, n/k/a/ Natallia Washburn (appellant) v. Uladzimir Davydzenkau

Douglas County, Hon. Leigh A. Retelsdorf

Attorneys: Douglas W. Ruge (appellant); Chales Grimes (Vacanti Shattuck Attorneys)

Civil: Child support

Proceedings below: The district court determined that the temporary Illinois Order prevented an award of retroactive child support; that there was insufficient evidence to award medical expenses; did not impute income to the Appellant; and did not award the Appellant attorney fees.

Issue: The district court erred in 1) ruling that there was not sufficient evidence of past medical expenses and that the Appellant is prevented from establishing medical expenses and cannot get medical expenses as she does not have documentation dating back to 2002 for medical expenses, 2) failing to impute Appellee's income which was established in excess of the income reported on the tax return, 3) calculating the child support obligations, 3) failing to impute Appellee's income

which was established in excess of the income reported on the tax return, 4) failing to award retroactive child support prior to filing of the instant action; ruling that the Court is prevented from

ordering child support prior to the filing of the instant action because of the temporary lllinois Order; and by not awarding retroactive child support to the time prior to the Illinsis Temporary Order. Appellant further assigned that 5) the referee erred in failing to award child support for the minor child Lisaveta beyond the age of majority due to her handicap and 6) the referee erred in failing to award attorneys' fees to the Appellant.
