Case Summary

A-17-380, Brandon Hudiburgh (Appellant) v. Justine Galvan

Hall County, District Court Judge Mark J. Young

Attorney for Appellant: Mitchell C. Stehlik (Lauritsen, Brownell, Brostrom & Stehlik, P.C., L.L.O.)

Attorney for Appellee: Jonathan M. Hendricks (Dowding, Dowding & Urbom Law Office)

Civil Action:  Paternity and Custody

Action Taken by Trial Court:  The district court determined Appellant is the father of a minor child with Appellee. The district court awarded the parties joint legal custody and awarded Appellee the sole physical custody of the minor child. Appellant was awarded visitation and was ordered to pay child support and make contributions to the minor child’s medical care and daycare. The district court did not award Appellant a tax exemption for the minor child.

Assignments of Error on Appeal:  Appellant assigns that the district court abused its discretion in (1) failing to award him joint custody of the minor child; (2) failing to award the dependency tax exemption on an equal basis; and (2) determining an amount of child support that did not reflect his actual economic circumstances.
