Christy Black (Appellee) v. Lorna Brooks (Appellant)

Douglas County, Judge Leigh Ann Retelsdorf

Attorneys:  Catherine Mahern, Attorney, and Wesley Van Ert, Brett Wessels and John Beauvais, Senior Certified Law Students (Appellee) (Milton R. Abrahams Legal Clinic) --- Brent M. Kuhn (Appellant) (Harris & Kuhn).

Civil:  Landlord–Tenant dispute

Proceedings Below:  The district court found that Brooks had wrongfully withheld Black’s security deposit and willfully breached the lease agreements. The court awarded damages and also awarded attorneys’ fees under the applicable statutes.

Issues on Appeal:  Brooks assigns, restated, that the district court erred in (1) finding that Brooks had wrongfully withheld Black’s security deposit; (2) awarding attorneys’ fees to Black; and (3) finding that Brooks had not met her burden under her cross-complaint against Black for breach of the lease agreements.
