Civil: Adjudication order requiring mother’s release of information to NDHHS

 

Proceedings below: The child was adjudicated under Neb. Rev. Stat. § 43-247(3)(a). As part of the adjudication, the mother was ordered to participate in pretreatment assessment and sign releases of information to allow NDHHS an opportunity to access information from Appellant’s therapist and treatment providers.

 

Issues: The juvenile court erred in (1) ordering Appellant to participate in a pretreatment assessment; (2) ordering Appellant to sign releases of information to allow NDHHS to access information from Appellant’s therapist and treatment providers; (3) ordering a rehabilitation plan that was unreasonable and immaterial to the issues adjudicated; (4) violating HIPAA by failing to limit the scope of court ordered releases of information.
