Richardson County District Court, Judge Daniel E. Bryan

Attorneys: Gary J. Nedved (Keating, O’Gara, Nedved & Peter, P.C., L.L.O.) (Appellants) --- Mark C. Laughlin & Jacqueline M. DeLuca (Fraser Stryker PC LLO)

Civil: Breach of fiduciary duty; negligence; partial summary judgment; damages

Issues: The district court erred in 1) failing to grant Appellants’ motion for new trial on the issue of damages, and 2) granting Appellee’s motion for partial summary judgment and finding for Appellee as a matter of law on Appellants’ claim for damages for the initial insurance premium payments made directly to the insurance companies.

Issues on Cross-Appeal: The district court erred in 1) denying Appellee’s motion for partial summary judgment, his motion for reconsideration, and his motion for settlement credit, and 2) granting Appellants’ motion for partial summary judgment.
