Court Number

Case Summary

A-15-0734 State v. Joseph D. Senn, Jr. (Appellant)

Richardson County, Judge Daniel E. Bryan, Jr.

Attorneys: Keith M. Kollasch (Appellant) --- George R. Love (Attorney General's Office)

Criminal: Carrying a concealed weapon

Proceedings below: A jury found Appellant guilty of carrying a concealed weapon. On appeal, the conviction was reversed by the Court of Appeals. See State v. Senn, 24 Neb. App. 160 (2016). The State of Nebraska filed a Petition for Further Review which was granted by the Nebraska Supreme Court.

Issues: 1. The Court of Appeals erred in applying a civil case proposition of law to a criminal case where the proposition states an appellate court will decide a case on the theory on which it was presented in the trial court. 2. The Court of Appeals erred in finding the evidence insufficient for a rational trier of fact to conclude Senn was guilty of carrying a concealed weapon.
