Civil: Paternity, Disestablishment of Paternity and Custody

Proceedings below: Indraja was married to Indraneel when she conceived and gave birth to twins.  Genetic testing, however, showed that Apurba was the biological father of the twins with over 99.99% certainty.  The district court disestablished paternity of husband (Indraneel), found Apurba to be the father of the minor children, and awarded joint physical and legal custody of the children to Apurba and Indraja.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket. 

Issues: On appeal, Appellant makes the following assignment of error:  the district court erred in failing to grant Appellant’s motion to dismiss.

On cross-appeal, Appellee/Cross-Appellant makes the following assignments of error: 1) The District Court erred in failing to grant Indraneel’s Motion to Dismiss; 2) The District Court erred in failing to grant Indraja’s Motion to Dismiss; 3) The District Court erred in granting Apurba’s Motion for Partial Summary Judgment; and 4) The District Court erred in exercising jurisdiction over the subject matter of this action.
