Proceedings below: Following a hearing, Nebraska Department of Correctional Services sanctioned Appellant for violating a rule pertaining to drug or intoxicant abuse. When the Appeals Board affirmed this sanction, Appellant used Administrative Procedure Act to appeal to the district court, which affirmed the sanction. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following arguments: 1) The district court erred when it found that in its plain language 009.01 does not entitle Haynes to a urinalysis test; and 2) The district court abused its discretion when it found the evidence had a sufficient indicia of reliability.
