Case Summary

S-23-0301 Sandra Lopez (Appellant) v. Catholic Charities of the Archdiocese of Omaha, Inc., A Nebraska Non-Profit Corporation (Appellee)

Appeal from District Court for Douglas County, Judge Timothy P. Burns

Attorneys:  Thomas M. White, Amy S. Jorgensen, and Hannah Schweitzer, Senior Certified Law Clerk  (White and Jorgensen for Appellant) and Heather B. Veik (Erickson | Sederstrom, P.C., LLO for Appellee).

Civil:  Intentional Torts and Workers’ Compensation

Proceedings below:  The district court dismissed the Appellant’s claims of assault and intentional infliction of emotional distress against her former employer because the Nebraska Workers’ Compensation Act provided the exclusive remedy.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues:  Appellant makes the following assignment of error:  1) The District Court erred in granting Catholic Charities’ motion to dismiss Lopez’s claims for the torts of assault and intentional infliction of emotional distress.
