Case Summary

S-23-0062 Chuck McKay (Appellant) v. Anita Bartels, Stephanie Krivohlavek, Phil Hardenburger, Marvin Kohout, Russ Karpisek, and Janet Henning (Appellees)

Appeal from District Court for Saline County, Judge David J.A. Bargen

Attorneys:  Lyle Joseph Koening (Koening Law Firm for Appellant) and Tad E. Eickman (Special Deputy Saline County Attorney for Saline County Clerk and County Commissioners/Appellees)

Civil:  Election Law and Declaratory Judgment

Proceedings below:  The district court dismissed Appellant’s declaratory judgment with prejudice because the district court concluded that Appellant’s exclusive remedy was an election contest pursuant to Neb. Rev. Stat. §§ 32-1101 et seq. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues:  Appellant makes the following assignment of error:  1) The District Court erred in finding that Neb. Rev. Stat. § 32-1001 et seq. was the exclusive remedy for the plaintiff's claims.
