Case Summary

S-22-0254 Brian M. Noland (Appellant) v. Erin Yost (Appellee)

Appeal from the District Court for Sarpy County, Judge Nathan B. Cox

Attorneys: Ashley A. Albertsen (Oestmann & Albertsen Law for Appellant).  No brief filed by Appellee.

Civil: Domestic relations, Custody, and In Loco Parentis

Proceedings below: Following a bifurcated evidentiary hearing, the trial court found that Appellant stood in loco parentis to his step-daughter until September 2021, when he filed for divorce.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues: On appeal, Appellant makes the following arguments:  1) The Order dated March 17, 2022 is a final appealable order; 2) If the Court determines the March 17, 2022 Order is not a final appealable order than it is an interlocutory order and an interlocutory appeal is appropriate; and 3) The Court incorrectly found that Appellant had lost his in loco parentis status.
