Case Summary

S-22-0326 Pinnacle Bancorp, Inc. (Appellant) v. Bruce Moritz and Nebraska Commissioner of Labor (Appellees)

Appeal from the District Court for Sarpy County, Judge George A. Thompson

Attorneys: Leigh Campbell Joyce (Baird Holm LLP for Appellant), Douglas R. Novotny (Novotny Law, LLC for Appellee Bruce Moritz) and Katie S. Thurber (Nebraska Dept. of Labor for Appellee Nebraska Comm. of Labor)

Civil: Unemployment benefits

Proceedings Below: The district court affirmed the decision of the Nebraska Department of Labor Appeal Tribunal which determined that Appellee was not disqualified from receiving unemployment benefits because he did not engage in misconduct connected to his work.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues: On appeal, Appellant makes the following assignments of error:  1) The District Court erred when it held that Moritz’s online misconduct was not connected to his employment; 2) The District Court erred in ruling that Moritz was not disqualified from receiving unemployment benefits; and 3) The District Court erred in failing to make a finding that Moritz had created the social media posts that resulted in his termination.
