Civil: Dissolution of Marriage, Alimony, and Division of Debt and Assets

Proceedings Below:  The district court entered a Decree of Dissolution of Marriage that awarded Appellee alimony, ordered Appellant to pay Appellee an equalization payment, and divided student loan debts that Appellee incurred on behalf of the parties’ adult children. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues: Appellant makes the following assignments of error:  1) The Trial Court erred in awarding alimony by failing to acknowledge all relevant financial circumstances including Juli's recent large receipt of inheritance, Cyrus's advanced age, and Cyrus's inability to pay as compared to Juli's need for alimony; 2) The Trial Court erred in ordering an over $50,000.00 equalization payment, when Juli was awarded assets which were excluded from the marital debt asset worksheet and failing to provide credit for ordinary expense deduction in the marital estate; and 3) The Trial Court erred in ordering debt associated with Parent Plus loans, taken out exclusively in the name of Juli for the benefit of the parties' adult children, were to be considered a debt which was marital and subject to equal division.
