Case Summary

S-22-0822 James Saylor (Appellant) v. State of Nebraska (Appellee)

Appeal from the District Court for Lancaster County, Judge Robert R. Otte

Attorneys:  Joshua D. Barber (Barber & Barber, P.C., L.L.O. for Appellant) and Eric J. Hamilton and Christian Edmonds (Solicitor General and Asst. Solicitor General from the Attorney General’s Office for Appellee)

Civil: Nebraska State Tort Claims Act and Claim Preclusion

Proceedings Below:  The Supreme Court has previously heard this matter at Saylor v. State, 304 Neb. 779, 936 N.W.2d 924 (2020) (Saylor I) and at Saylor v. State, 306 Neb. 147, 944 N.W.2d 726 (2020) (Saylor II). After the Court remanded the case to the trial court in Saylor II, the trial court sustained Appellee’s Motion for Judgment on the Pleadings.

Issues: Appellant makes the following assignments of error:  1) The District Court erred in sustaining the State’s motion for judgment on the pleadings; and 2) The District Court erred in determining that Saylor’s action was barred by the doctrine of claim preclusion.
