S-23-0356 State of Nebraska (Appellee) v. Melvin Lear (Appellant)

Appeal from the District Court for Buffalo County, Judge John H. Marsh

Attorneys: D. Brandon Brinegar (Buffalo County Public Defender’s Office for Appellant) and Jordan M. Osborne (Asst. Attorney General for Appellee)

Criminal: Speedy Trial

Proceedings below: After the State charged him with distribution of a controlled substance, Appellant filed a Motion to Discharge his criminal charges for violating his right to a speedy trial, which the district court overruled.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues: Appellant makes the following assignment of error: 1) The trial court erred in ruling that Appellant had waived his right to a speedy trial and denying Appellant’s Motion for absolute discharge.
