Civil: Domestic Abuse Protection Order; Harassment Protection Order

Proceedings below: The district court issued a harassment protection order and declined to issue a domestic abuse protection order.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket. 

Issues: On appeal, Appellant makes the following assignments of error:  1) The District Court erred in finding the Appellee had met her burden of proof for the issuance of a Harassment Protection Order for herself; 2) The District Court erred in finding that the Appellee had met her burden of proof for the issuance of a Harassment Protection Order for the minor children, Nola T. and Nash T.; 3) The District Court erred in continuing the harassment protection order when the Appellee elected to pursue the theory of a domestic abuse protection order at the Show Cause Hearing; such action violated the Appellant’s procedural due process rights, and 4) The Appellant’s appeal should not be found as moot if the expiration of the protection order occurs prior to this Court’s decision on appeal.
