Action Taken by Trial Court: The jury convicted Appellant of one count of murder in the second degree, one count of assault in the second degree, and two counts of use of a deadly weapon to commit a felony. Assignments of Error on Appeal: On appeal, Appellant alleges that the district court erred in (1) denying his motion to suppress evidence obtained through a Facebook account tracking device; (2) denying Appellant’s motion to suppress evidence obtained through arrest and search warrants; (3) denying Appellant’s motion in limine to exclude evidence obtained from a residence pursuant to Nebraska Rule of Evidence 403; (4) denying Appellant’s motion for mistrial when a witness invoked his Fifth Amendment privilege; (5) finding sufficient evidence to support the jury’s verdicts, and; (6) imposing an excessive sentence.
