Proceedings below:  The Counsel for Discipline filed formal charges against the Respondent, and after the Referee report was filed, Respondent filed a statement of errors and objections.

Issues:  Respondent has submitted the following statement of errors and objections:  1) Respondent objects to the portion of the recommendation in the Report of Referee “that the respondent, Amy A. Miller, be suspended from the practice of law for 30 days;” 2) A public reprimand is sufficient, without the need for a suspension, to satisfy all of the State ex rel. Counsel for Dis. v. Trembly, 300 Neb. 195 (2018) factors; 3) A public reprimand is sufficient to fully serve the purposes of this disciplinary process; 4) The Report of Referee is deficient in that it does not reconcile its findings concerning the Trembly factors in her case with similar cases; 5) Respondent asserts that the Referee got the facts right, the Referee correctly cited to the appropriate caselaw, and then failed to adequately explain why he recommended an unnecessary and excessive suspension.
